Image Licence Agreement

1. You must accept the Image Licence Agreement (the 'Licence' or 'Agreement') before using the image. By opening or using the image, you (the 'Licensee' or 'Licence Holder') agree to be bound by the terms and conditions of the Image Licence Agreement. The Whole World Company Limited ('we', 'us', 'our', trading as Whole World Company Images and WholeWorldCompany.com) and Photographers agree to grant a Licence to use the image on payment of the correct Licence fee. This Licence describes all allowed uses of the image: any use or action not explicitly stated is prohibited, and all other uses and rights are reserved. If you do not accept the terms of the Image Licence Agreement, do not open or use the image.
2. The Licence entitles you (the 'Licensee') to install and use one image. You may store or make one backup copy, provided that the backup copy is used only for archival purposes. The image may not be stored on an open network.
3. The number of impressions must not exceed the amount stipulated in the Licence.
4. The Photographer hereby asserts his/her moral rights as author of the photograph(s). You may not remove or alter the Photographer's name, Company name, copyright notice or disclaimers from the Licence. All uses of the image must be accompanied by a credit to Whole World Company Images and the Photographer, as close to the image as possible, in the format: Whole World Company Images/Photographer's Name.
5. Within one month of publication of the image, the Licensee must send an original or reference copy of the publication of the image to Whole World Company Images.
6. The Licence Holder is responsible for compliance with the Image Licence Agreement. Licence Holders must ensure that users are not able to make additional copies above the Licence limit, in any medium. You may not give, sell, make available, lend, print, lease or sublicense the image, copies of the image, or any part of the image to anyone other than licensed users, or facilitate or provide facilities for this. You may not mount, upload or distribute any part of the image on an open network, including without restriction the Internet and the World Wide Web.
7. If the image includes more than one file format or medium, the total number of copies used must not exceed the Licence amount regardless of file format or medium. You may not give, transfer, sell, make available, lend, print, lease or sublicense any formats or media you do not use.
8. The image is licensed as a single, one-off product. Apart from cropping, it may not be divided for multiple uses.
9. The terms of the Image Licence Agreement apply to all and any image formats and media. This Agreement supersedes all previous Image Licence Agreements for the image.
10. Small website images and sample comp images are for sample purposes only and are not for publication.
11. Do not make illegal, unauthorized copies of the image. The image is protected by copyright law and international treaties. Unauthorized reproduction or distribution, in whatever form or medium, is strictly prohibited. No part of the image may be reproduced, translated, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, printing, photocopying, recording or otherwise, except as stipulated in the Licence Agreement or with the prior written permission of The Whole World Company Limited.
12. This Licence applies to the image and to all of its parts, both individually and as a whole. If any part of this Licence is invalid or unenforceable, the validity and enforceability of the remaining terms and conditions of the Licence shall not be affected.
13. The Licensee is responsible for securing all relevant permissions relating to the use of the image in the territory or territories where it will be published. This may include people, objects and buildings, copyright, trademarks and privacy.
14. The Photographer and The Whole World Company accept no responsibility for any loss or inconvenience, or for any claim by any third party, as a consequence of the use or publication of an image. The Whole World Company's maximum liability is the fee charged for the Licence. We are not liable for any type of special, consequential or indirect loss.
